These terms apply to membership of the “Easyart Academy” operated by King & McGaw Limited. By joining the Easyart Academy, you accept these terms and conditions.
This Agreement is between King & McGaw Limited (that is, “we” or “our”) and “you” the member of the Easyart Academy. Further Terms & Conditions relating to Security & Privacy and the general operation of King & McGaw Limited and its websites can be found here.
The Easyart Academy is an online image gallery which charges a fee for the submission of digital images with a view to offering them for sale as reproduction prints. On receipt of a customer order Easyart will take payment, print individual images to the customer's specification, package and arrange delivery. A royalty will be paid to the subscriber against each completed sale.
As an Easyart Academy member you will be provided with an individual URL to use to promote and direct traffic direct to your submitted artwork. You may also submit textual profile information, which we will display with your images. In uploading your work, you grant us the right to use images of your artwork and your profile information to promote those and the Easyart Academy as we see fit.
This may include distribution of low resolution images to other websites operated by Easyart and to our network of affiliates in order to promote sales of your work.
The Academy is designed for participants aged 18 and above who can form legally binding contracts under applicable law. By accepting this Agreement and participating in the Academy, you acknowledge that you are aged 18 or above.
We are committed to promoting art in all its guises however we do reserve the right to reject any individual submission if we do not feel it is appropriate for the Academy. You will be given the opportunity to submit an alternative. You may submit images to your total capacity at any time during the duration of your subscription however once live, an image cannot be replaced, only removed.
You are solely responsible for all artwork and profile information submitted and you warrant that this is your own original work and you are the copyright owner. You also warrant that such artwork does not infringe the copyright or other intellectual property rights of any third parties.
You agree to categorise your submissions in the most accurate way possible and will not attempt to promote products or services other than those of Easyart.com.
We reserve the right to edit or remove without notice to you, any information or images submitted as we see fit, particularly in regards to the above.
Upload fees are shown inclusive of applicable taxes in Pounds Sterling (£). Prices, offers and services are subject to change without notice. The upload fee is a non-refundable once-off charge per image uploaded.
You may remove images from the Easyart Academy at any time. Upload fees are non-refundable.
We make no representation that the operation of our website www.easyart.com or others operated by us will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or downtime. We make no representation regarding the compatibility of your computer when used to access our website.
You agree to indemnify and hold harmless Easyart and its subsidiaries and affiliates, and their directors, officers, employees, agents, shareholders, partners, members, and other owners, against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable legal fees) incurred by us and arising out of or in connection with your artwork, activities or the content of your profile information, including, without limitation, any actual or alleged infringement of copyright or other intellectual property rights.
Easyart is not responsible for and to the fullest extent permitted by law exclude all liability for any losses or damages arising from or in connection with your individual artwork or profile information as displayed.
Easyart shall not be liable for any loss of revenue, profits, data, indirect, special, or consequential damages arising in connection with this agreement even if we have been advised of the possibility of such damages or if such damages were reasonably foreseen at the date of this agreement.
Easyart and the subscriber are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the Parties.
If any term, clause or provision of this Agreement shall be deemed invalid or unenforceable for any reason, the remainder of this Agreement shall remain valid and enforceable in accordance with its terms.
These terms and conditions are governed by English law, and any dispute shall be submitted to the exclusive jurisdiction of the English Courts.
We reserve the right to modify these Terms & Conditions at any time by posting such change here.
